NOTICE IS HEREBY GIVEN, that separate sealed proposals for General Construction Work Contract,
Mechanical Work Contract, Plumbing Work Contract, and Electrical Work Contract are sought and
requested for:
CONSTRUCTION OF
MEMORIAL PARK COMMUNITY LODGE
Town of Gates
County of Monroe
State of New York
to be let by the Town of Gates according to the plans and specifications prepared by Costich
Engineering, D.P.C. and Architectura, P.C. Contract documents shall be available for review April 8, 2025.
The sealed proposals will be received by the Town of Gates Public Works Department at the Town Hall,
1605 Buffalo Road, Rochester, NY 14624, until the 29th day of April, 2025 at 1:00 p.m. prevailing time,
at which time and place they will be publicly opened and read aloud.
Copies of the Contract Documents, including drawings and technical specifications, in both digital
download and printed formats may be obtained from Rotolite Elliott, P.O. Box 97, One Grove Street,
Pittsford, New York 14534, 585-385-1463 (voice) 585-385-2190 (fax), www.recplanroom.com, at cost. A
hard copy of the Contract Documents will be available for preview at the Town of Gates Town Hall Clerk’s
Office.
The bidding documents must be obtained through Rotolite-Elliott in order to be considered a Plan Holder
of Record. Bidding documents obtained from any other source are for examination only, and are not
considered complete and are not valid for bidding purposes.
Each bid must be accompanied by a certified check or a bid bond in an amount not less than
5% of their bid in the form, and subject to the conditions set forth in the Contract Documents and
Instructions for Bidders.
A Non-Mandatory Pre-Bid meeting will be conducted on April 17, 2025 at 1:00 p.m. Prospective bidders
shall meet at the project site, located at Memorial Park, 160 Spencerport Road, Rochester, NY 14606.
Following the meeting, an addendum will be issued to all plan holders addressing comments within reason.
If the date and time or location of the Pre-Bid meeting is to change, contractors on the plan holders list will
be notified via email.
Upon acceptance of their bid, if the successful bidder fails to enter into a contract pursuant to the requirements of said agency, then the sum deposited as aforesaid shall be forfeited to the
Town of Gates as liquidated damages, or the payment of the bond enforced for the benefit of
the Town of Gates.
No bidder may withdraw his bid for a period of forty-five (45) days after the date set forth for the
opening thereof, and may not withdraw it at any time prior to the opening of bids. Each bidder’s attention
is called to the General Municipal Law, which requires a bidder’s signed Certificate of Non-Collusion,
copies of such certificates are part of the proposal form and unless complied with, the bid will not be
accepted.
The successful bidder must furnish 100% Performance Bond.
The Town of Gates is exempt under Section 1116 of the Tax Law, and, therefore, no sales
tax shall be included in the bid.
Women- , Minority- , and Veteran-Owned Businesses are encouraged to submit bids.
The attention of bidders is directed to the Contract Provisions governing selection and employment of labor.
Prevailing Wage Rates (Monroe County, NY) apply for this project in accordance with New York
Department of Labor Article 8.
This project is funded by the U.S. Department of Housing and Urban Development (HUD). Therefore, all
federal regulations governing contracts apply, including Labor Standards Provisions and Davis-Bacon wage
rates, Equal Employment Opportunity regulations and Section 3 Provisions, as well as Build American,
Buy American (BABA) provisions.
No bids shall be accepted from, or any contract awarded to any person or corporation who is in
arrears to the Town of Gates upon any debt of Contract, or is a defaulter as surety or
otherwise upon obligation to the Town of Gates.
The Town of Gates also reserves the right to waive any informality in or to reject any and all
Bids, or to waive any nonconformity or irregularity in any bid, and to award the Contract in the Town’s
best interest. It further reserves the right to limit the amount of the award. The Town of Gates reserves the
right to reject any and all proposals and re-advertise at its discretion.
The consultant contact for the Memorial Park Community Lodge as designated by the Town of Gates shall
be the sole point of contact for all questions and clarifications needed for the contract documents. All
requests for information or clarification shall be made in writing to the project bidding point of contact:

opening.
